GovClerk (Pty) Ltd ("GovClerk", "we", "us", "our") is committed to protecting your personal
information and your right to privacy. This Privacy Policy explains how we collect, use, store,

The Protection of Personal Information Act (POPIA) is South Africa's comprehensive data
privacy law, effective since 1 July 2021. GovClerk is committed to full compliance with
POPIA and processes your personal information lawfully, in a reasonable manner that does not
infringe on your privacy.
GovClerk acts as a Responsible Party under POPIA. This means we determine the
purpose of and means for processing your personal information and are accountable for ensuring
that processing complies with the Act.

4. How We Use Your Information

To provide and maintain our Services (GovClerkMinutes and GovClerk Portal).
To process your meetings: transcription, minutes generation, and speaker identification.
To manage your account and subscriptions.
To process payments securely via PayStack.

To improve our Services and develop new features based on usage patterns.
To comply with our legal obligations under applicable law, including POPIA.
To send notifications about your GovClerk Portal (for Portal users), including meeting publications and live broadcast alerts.
5. How We Share Your Information
We do NOT sell your personal information to third parties for marketing or
any other commercial purpose.
We may share your information in the following limited circumstances:
Service Providers
We work with trusted third-party service providers who assist us in operating our Services.
These providers are contractually bound to process your data only in accordance with our
instructions and applicable law:
AI Transcription Services — for meeting transcription and minutes generation.
Cloud Hosting (AWS) — for secure data storage and infrastructure.
Email Delivery (Postmark) — for transactional and service-related emails.
Payment Processing (PayStack) — for subscription and billing management.
Analytics (PostHog) — for usage analytics to improve our Services.
CRM (Brevo) — for customer relationship management.
Legal Requirements
We may disclose your information if required to do so by law, regulation, or valid legal
process (such as a court order or subpoena), or if we believe in good faith that such
disclosure is necessary to protect the rights, property, or safety of GovClerk, our users,
or the public.
Business Transfers
In the event of a merger, acquisition, or sale of all or a portion of our assets, your
personal information may be transferred to the acquiring entity. We will notify you via email
or a prominent notice on our Sites prior to any such transfer.
With Your Consent
We may share your information for other purposes when you have explicitly authorised us to do so.
GovClerk Portal — Public Documents
Meeting documents published to your public GovClerk Portal are accessible to the general
public by design. This is the core purpose of the transparency portal — enabling government
organisations to share meeting records with citizens and stakeholders. Please ensure you only
publish documents you intend to make publicly available.
6. Data Storage and Security
We take the security of your personal information seriously and implement appropriate
technical and organisational measures to protect it:
Data is stored on secure cloud infrastructure provided by Amazon Web Services (AWS).
Data is encrypted at rest and in transit using industry-standard encryption protocols.
Access controls and user authentication are managed via Clerk.
We conduct regular security assessments to identify and address vulnerabilities.
Our data handling practices align with SOC 2 compliant standards.
Despite our best efforts, no method of transmission over the Internet or method of electronic
storage is 100% secure. While we strive to use commercially acceptable means to protect your
personal information, we cannot guarantee absolute security. By using our Services, you
acknowledge and accept this inherent risk.
7. Cookies and Tracking
We use cookies and similar tracking technologies to enhance your experience on our Sites.
Cookies are small text files stored on your device that help us recognise you and remember
your preferences.
Essential Cookies
These cookies are necessary for authentication and session management. They cannot be disabled
as they are required for our Services to function.
Analytics Cookies
We use PostHog to collect anonymised analytics data that helps us understand
how users interact with our Sites and improve our Services.

We use Meta Pixel for advertising purposes to measure the effectiveness of

Right to correction — You may request that we correct any inaccurate or incomplete personal information.
Right to deletion — You may request that we delete your personal information, subject to our legal obligations to retain certain data.

Right against automated decision-making — You have the right not to be subject to a decision based solely on automated processing that significantly affects you.

9. Data Retention
We retain your personal information for as long as your account remains active.
Meeting recordings and transcripts are retained for as long as you maintain your subscription.
Following account deletion or subscription cancellation, your data will be purged within 90 days, subject to any legal obligations.
Some information may be retained for a longer period if required by applicable law or regulation.
10. Children's Privacy
Our Services are not directed to anyone under the age of 18. We do not knowingly collect
personal information from children under 18 years of age. If you are a parent or guardian and
believe that your child has provided us with personal information, please contact us

we will take steps to remove such information from our systems.
11. International Data Transfers
Your personal information may be processed in countries outside South Africa, including the
United States, where our cloud hosting provider (AWS) operates data centres. Where such
cross-border transfers occur, we ensure that appropriate safeguards are in place as required
by POPIA, including contractual protections to ensure your data receives an equivalent level
of protection to that afforded within South Africa.
12. Third-Party Links
Our Sites may contain links to third-party websites or services. We are not responsible for
the privacy practices or content of those sites. This Privacy Policy applies solely to
information collected by GovClerk through our Sites and Services. We encourage you to review
the privacy policies of any third-party sites you visit.
13. Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. Significant changes
will be communicated to you via email to the address associated with your account, or by
placing a prominent notice on our Sites. Such changes will take effect 30 days
after notification to allow you time to review the updated policy.
Non-material changes or clarifications will take effect immediately upon posting. We encourage
you to review this Privacy Policy periodically to stay informed about how we protect your
